1. Acceptance of terms

By contacting NestWatch Detectives (“we”, “our”, or “the Agency”), engaging our services, signing a work order, or making any payment to us, you (“the Client”) agree to be fully bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and NestWatch Detectives, registered and operating from Jaipur, Rajasthan, India. If you do not accept these Terms, do not engage our services.

2. Our services

NestWatch Detectives provides professional private investigation and verification services including, but not limited to: matrimonial investigations (pre-matrimonial and post-matrimonial), corporate investigations, background verification, missing person tracing, skip tracing, loyalty test investigations, undercover sting operations, assets and wealth verification, and competitive intelligence.

All services are conducted within the framework of applicable Indian law. We reserve the right to decline any engagement that, in our professional judgement, falls outside legal boundaries, compromises our investigators' safety, or conflicts with our ethical standards.

The scope, deliverables, timeline, and cost of each engagement are defined in a signed Work Order / Client Agreement specific to that case. In the event of any conflict between these Terms and a specific Work Order, the Work Order shall prevail for that engagement only.

3. Consultation terms

3.1 Free telephone / WhatsApp consultation

A free initial consultation is available by phone or WhatsApp only, for a maximum duration of five (5) minutes. This consultation is intended solely to help you understand whether our services are appropriate for your situation. No detailed case discussion, investigation planning, or legal advice is provided within a free consultation. The free consultation does not create any obligation on either party and does not constitute the commencement of an engagement.

3.2 In-office appointment

In-person meetings at our Jaipur office require a prior appointment. An appointment booking charge of ₹5,000 (Rupees Five Thousand) is applicable for all in-office consultations. This charge is payable at the time of booking and is non-refundable. The appointment charge is not applied toward any future investigation fees. Extended consultations beyond the standard appointment duration may incur additional charges, which will be communicated in advance.

3.3 Consultation by other means

Consultations over video call, extended phone calls beyond the 5-minute free window, or other personalised formats are considered paid engagements and will be quoted separately.

4. Work order, agreement, and report delivery

No investigation will commence and no written report will be delivered without a duly signed Work Order or Client Agreement between NestWatch Detectives and the Client.

The Work Order will specify: the scope of investigation, agreed deliverables, estimated timeline, fee structure, advance payment amount, and the identity of the authorised Client representative (Point of Contact).

Verbal instructions, WhatsApp messages, or emails do not constitute an authorised work order. All amendments to scope or deliverables must be agreed in writing and signed by both parties.

The completed investigation report and all supporting evidence will be shared with the Client only after: (a) a valid, signed Work Order is in place, and (b) all outstanding payments, including investigation expenses, have been cleared.

5. Fees, payment, and advance

5.1 Advance payment: An advance payment, as specified in the Work Order, is required before any investigation begins. The advance amount varies by case type and complexity and will be communicated during the consultation.

5.2 Non-refundable advance policy

Once an investigation has commenced, the advance payment is strictly non-refundable under any circumstances, including if the Client chooses to withdraw, the subject relocates, the case becomes unworkable due to client-supplied inaccurate information, or any other reason. This reflects the deployment of investigator resources, time, and operational costs already incurred at the commencement of investigation.

5.3 Investigation expenses (billed separately): All out-of-pocket expenses incurred during the course of investigation are billed separately and are not included in the base investigation fee unless explicitly stated in the Work Order. These expenses include, but are not limited to: travel costs (within city, inter-city, and interstate), accommodation for field investigators, surveillance equipment deployment, database access charges, documentation and certification costs, and any other direct operational expense. Expense bills and receipts will be provided. Expenses must be settled by the Client promptly upon invoice.

5.4 Payment modes: Payments are accepted by bank transfer (NEFT/IMPS/RTGS), UPI, or cheque. Cash payments are accepted only at our Jaipur office with a signed receipt. All payments must reference the case ID.

6. Daily reporting schedule

Reporting window: 6:00 PM to 8:00 PM IST daily

Daily progress updates on active investigations will be provided exclusively between 6:00 PM and 8:00 PM Indian Standard Time (IST), Monday through Sunday. Updates outside this window will not be provided except in exceptional circumstances (e.g., a critical finding that requires immediate client input).

The Client should ensure their designated Point of Contact is available to receive updates during this window. Missed updates during the reporting window will not be rescheduled to another time. Queries or clarifications from the Client may be submitted at any time via WhatsApp or email; responses will be provided during the next available reporting window unless urgent.

We will not accept or respond to multiple simultaneous communication channels for case updates. All reporting will be directed to the single authorised Point of Contact (see Section 8).

7. Single point of contact

NestWatch Detectives will communicate exclusively with one (1) designated Point of Contact (POC) from the Client's side for the entirety of the engagement.

The name, phone number, and email address of the authorised POC must be specified at the time of signing the Work Order. We will not engage with, take instructions from, share information with, or provide updates to any other individual — regardless of their relationship to the Client — unless the Client formally notifies us in writing to change the designated POC.

If the Client wishes to involve additional persons (such as a family member, legal counsel, or business partner), this must be agreed in writing before any information is shared with them. We reserve the right to suspend case communication if multiple unauthorised contacts attempt to reach our team, until a single POC is confirmed.

8. Report and evidence usage restrictions

Strict restriction on use of reports and evidence

All investigation reports, photographs, video footage, surveillance logs, written findings, and any other material produced or compiled by NestWatch Detectives during an engagement are the proprietary work product of the Agency. These materials are delivered to the Client for their personal, private use only and may not, under any circumstances, be reproduced, shared, published, uploaded online, exhibited, submitted in any legal or quasi-legal proceeding, disclosed to any media, or used in any other manner without the prior explicit written consent of NestWatch Detectives.

Any unauthorised use, disclosure, or distribution of our reports or evidence may constitute a breach of this agreement and may expose the Client to legal action. The Agency reserves the right to seek injunctive relief and damages in such cases.

Consent for use in legal proceedings (e.g., submission as evidence in a court of law) must be obtained separately in writing, and may be subject to additional conditions and fees for preparation of court-compatible documentation.

9. Client obligations and accuracy of information

The Client agrees to the following obligations for the duration of the engagement:

  • Provide accurate, complete, and truthful information about the subject of investigation and the circumstances of the case. Inaccurate or misleading information provided by the Client that compromises the investigation does not entitle the Client to a refund
  • Maintain a single authorised Point of Contact and ensure that person is accessible during the daily reporting window
  • Not to instruct investigators to use unlawful methods or to conduct activities that violate Indian law
  • Not to contact or approach the subject of investigation during an active case without prior written approval from the Agency, as this may compromise the investigation
  • Settle all invoices and expense claims promptly as they fall due
  • Cooperate with the Agency's reasonable requests for additional information, approvals, or instructions as the investigation progresses

10. Client liability for legal matters

The Client shall be solely and fully liable for any and all legal consequences, claims, proceedings, or disputes arising from: (a) the use or misuse of investigation reports or evidence; (b) actions taken by the Client based on investigation findings; or (c) instructions provided by the Client that result in a legal dispute.

NestWatch Detectives conducts all investigations within the limits of applicable Indian law. We provide information and documented findings to clients; we do not take legal action, make decisions, or act as legal counsel. The manner in which you use the findings of an investigation is entirely your responsibility.

If any legal proceedings are initiated against NestWatch Detectives arising from a Client's instructions, misuse of evidence, or actions taken after receiving our reports, the Client agrees to indemnify and hold harmless NestWatch Detectives, its investigators, and its employees from any associated costs, claims, damages, or penalties.

11. Confidentiality and non-disclosure of the Agency

Non-disclosure obligation — binding on the Client

The Client agrees not to disclose the identity of NestWatch Detectives, the identity or personal details of any investigator or employee of the Agency, or the existence of any investigation engagement, to any third party — including the subject of investigation, their associates, family members, media, or any other person — without the prior written consent of the Agency. This obligation applies before, during, and after the course of investigation, with no time limit.

Breach of this confidentiality obligation may result in immediate termination of the engagement without refund, and may expose the Client to legal liability for damages suffered by the Agency or its investigators as a result of such disclosure.

In return, we commit to equal confidentiality: we will not disclose the Client's identity, case details, or findings to any third party without the Client's written consent, except as required by law.

12. No guarantee of outcome

Private investigation is an inherently uncertain discipline. While NestWatch Detectives brings 17+ years of experience and professional skill to every engagement, we make no guarantee as to the outcome of any investigation. Specifically, we do not guarantee:

  • That the subject will be located (in missing person or skip tracing cases)
  • That any specific finding will be uncovered
  • That the investigation will yield evidence sufficient for any particular legal purpose
  • That any specific timeline will be met, where delays arise from circumstances beyond our control

Our obligation is to conduct a professional, diligent, and lawful investigation to the best of our ability. Fee obligations are not contingent on any specific outcome.

13. Legal compliance

All investigations conducted by NestWatch Detectives are carried out strictly within the framework of applicable Indian law, including but not limited to:

  • The Indian Penal Code, 1860 (and Bharatiya Nyaya Sanhita, 2023)
  • The Information Technology Act, 2000 and its amendments
  • The Indian Evidence Act, 1872
  • The Code of Criminal Procedure, 1973
  • All applicable state laws of Rajasthan

We do not engage in: illegal phone tapping or interception of communications, hacking or unauthorised access to digital systems, trespassing on private property, impersonation of police or government officials, entrapment, or any other unlawful investigation method. Any Client instruction requiring us to engage in unlawful activity will be immediately refused and will result in termination of the engagement.

14. Limitation of liability

To the maximum extent permitted by applicable law, NestWatch Detectives, its investigators, employees, and associates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from the use of our services or investigation findings
  • Loss of business, financial loss, relationship breakdown, or emotional distress arising from or related to our findings
  • Any damage arising from the Client's misuse or unauthorised sharing of investigation reports or evidence
  • Delays caused by circumstances beyond our reasonable control, including subject relocation, unavailability of witnesses, or natural disruptions

Our total aggregate liability to any Client for any claim arising from an engagement shall not exceed the total fees paid by the Client for that specific engagement.

15. Intellectual property

All investigation reports, documentation formats, surveillance methodologies, written analyses, and proprietary processes used by NestWatch Detectives are the intellectual property of the Agency. The Client is granted a limited, personal, non-transferable licence to use delivered reports for their own private purposes only. No other intellectual property rights are transferred to the Client as part of any engagement.

16. Termination

By the Client: The Client may terminate an engagement at any time by providing written notice. All fees and expenses incurred up to the date of termination remain payable in full. The advance payment is non-refundable once the investigation has commenced.

By NestWatch Detectives: We reserve the right to terminate any engagement immediately, without refund, if: the Client provides false or misleading information, the Client breaches any provision of these Terms, the Client requests unlawful activities, the Client fails to make payment when due, or continuing the engagement poses a safety risk to our investigators.

Upon termination, partial reports or findings compiled to the date of termination may, at our discretion, be provided to the Client after settlement of all outstanding amounts.

17. Governing law and dispute resolution

These Terms of Service are governed by and construed in accordance with the laws of India. Any dispute arising from or in connection with these Terms or any engagement shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India.

Prior to initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days from the date the dispute is first raised in writing. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Jaipur.

18. Amendments to these terms

NestWatch Detectives reserves the right to amend these Terms of Service at any time. The updated version will be published on our website with a revised effective date. For ongoing engagements at the time of any amendment, the Terms in effect at the date the Work Order was signed shall apply for that engagement. New engagements entered into after the effective date of any amendment shall be governed by the revised Terms.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. The remaining Terms shall continue in full force and effect.
